THE CONTRACT

1. Definitions

2. To Make a Claim

To report a problem or malfunction please call 1-866-392-0344, or fill out our form online. Once coverage is acknowledged, AHW will contact a qualified contractor. The contractor will contact the homeowner to schedule a convenient appointment time. Homeowner is responsible for any overtime charges as a result of after hours service for non-emergency repairs. If an emergency service arises outside of normal business hours, the customer can dispatch the closest contractor and submit claim to AHW the next business day or as soon as reasonably possible by calling 1-866-392-0344. Emergency services are for Malfunctioning Furnaces, Water Heaters, Leaks or breaks in interior water and gas lines, and sewer backups.
AHW reserves the right to a second opinion concerning any problem or malfunction.
Standard business hours are Monday through Friday 8-5.

3. Transferring of Contract

If covered property is sold within the one-year time period. It is the seller’s responsibility to contact Alpine Home Warranty by phoning 1-866-392-0344 with the new owners information. Failure to do so eliminates any responsibility to Alpine Home Warranty LLC for the new owner.

4. Cancellation

A home warranty contract is non-cancelable for the term specified except when:

  1. Payment of contract fees is not received
  2. Fraud or misrepresentation has been presented
  3. Building being sold with a home warranty does not close

If contract is cancelled by Alpine Home Warranty LLC, customer will receive 100% of the unearned pro-rated amount less a $50.00 administrative fee. If AHW cancels contract due to non-payment a letter will be sent to contract address two weeks prior to cancellation. If cancelled for another reason, AHW will send a letter 30 days prior to end of coverage. If contract is cancelled by customer, AHW will refund 75% of the pro-rated unearned amount less a $50.00 administrative fee.

5. Approval and Condition

Alpine Home Warranty will not reimburse service contract holder for services performed without pre-approval. Pre-approval is achieved by calling our toll free number prior to receiving services from a qualified contractor. Coverage is only provided within the terms of this agreement. (Which is for a one-year period unless it is proven that it was not possible to file claim during the contract term) Contract covers only the items and systems mentioned in this agreement, all others are excluded from warranty. Covered items must exist within the perimeter of the foundation and includes an attached garage.
Covered items must be in good working condition at the beginning of the contract. Items not working will not be covered, as well as any other items not mentioned in this contract.

6. Payment, Service Fee, Agreement

Upon payment of full contract fee, AHW will repair or replace malfunctioning items that are covered during the term of this contract. In order to be repaired or replaced, claim must be pre-approved.
There is a deductible fee of $50.00 due to provider for each covered claim. An amount of $50.00 will also be charged to the homeowner for failing to keep a scheduled appointment. Failure to pay service fee may cause a delay in any future claims.

7. Utah Residents

This coverage afforded under this contract is not guaranteed by the Property and Casualty Guaranty Association.  Customer will allow the use of non-manufacturers’ parts as long as procedure complies with applicable state and federal laws. Non-manufacturers’ parts may be used when manufacturers’ parts are not available or can offer the same performance and functions as manufacturers’ parts. Service contract holder will be notified by AHW prior to the use of non-manufacturers’ parts.  Optional coverage for sellers begins upon the receipt of application by AHW and will continue until expiration of existing listing period, (listing period not to exceed 6 months). Buyers coverage starts at close of sale and will continue for the period of one year. Payment is due within 20 working days.  Obligations of the provider under this service contract are guaranteed under a service contract deposit.

8. Limits of Liability

  1. If contract applies to multi-unit-dwelling, condominium, or mobile home, AHW shall be obligated only with respect to repairs or replacement which can be performed within the confines of the units covered by this contract. AHW shall not be held liable for repairs or replacements for common areas or facilities of condominiums or mobile home parks. AHW shall be responsible for repairs or replacements within the walls of the covered units covered by this contract.
  2. Repairs or replacement of items caused by the following are not covered:
    Fire, flood, smoke, pest damage, acts of God, lightning, earthquake, freezing, theft, storms, accidents, mud, war, riots, improper installation i.e.: missing parts, incorrect installation, modified or replaced outside of manufacturers specifications, misuse, abuse, vandalism, water damage, lack of capacity, structural changes, electrical failure, electrical surges.
  3. AHW reserves the right to a second opinion at no extra charge to customer.
  4. AHW reserves the right to have a component or part rebuilt or to replace part or component with a rebuilt or refurbished part or component.
  5. AHW will not replace, refinish, or alter cabinets, countertops, tile, or flooring.
  6. This contract covers single-family residential properties that are less than 5,000 square feet, unless approved by AHW. Homes over 5,000 square feet are covered if approved by AHW and additional fees are paid. Contract coverage for residential use only, commercial property is excluded.
  7. AHW will determine whether a covered item will be repaired or replaced. Systems or appliances will be replaced with equipment with similar features, efficiencies, and capacities. AHW is not responsible for matching color, brand, or size to accommodate limited spaces.
  8. AHW is liable for covered items due to normal wear and tear. Cosmetic damage is not covered.
  9. AHW is not liable for consequential or secondary damage that may occur.
  10. The homeowner is responsible for any corrections, repairs, replacements, upgrades, or any extra costs related to complying with federal, state, or local laws, utility regulations, building codes, or zoning.
  11. AHW will not affect service that involves toxic or hazardous materials including asbestos or any other contaminant’s that may be found. AHW will not be held liable for any claim arising out of any pathogenic organism regardless of any event or cause that contributed in any sequence to damage or injury. These pathogenic organisms are bacteria, yeasts, mildew, fungi, virus, mold (including mold spores), mycotoxins, or other metabolic products.
  12. AHW will not be responsible for costs associated with or from manufacturer’s recall of any covered item, manufacturer’s defects, or any items that carry a manufacturer’s warranty that is currently valid. AHW will not be responsible for repair or replacement of items or systems deemed defective by the Consumer Product Safety Commission.
  13. AHW will not be liable for collapse piping, light bulbs, filters, pulleys, belts, bolts, nuts, wood, burglar and fire alarms, electronic or computerized system management controls or terminals.
  14. AHW is not responsible for any items outside the foundation of the home. These items include sprinkler systems, outside sewer lines, power lines, gas lines, underground wiring, and roofing.
  15. Problems caused by rust or corrosion during the first 45 days of the buyer’s coverage are excluded.
  16. Routine maintenance and failure to perform routine cleaning that is specified by the manufacturer will not be covered by AHW.
  17. AHW will not be responsible for permit fees, haul away and disposal fees. construction, or any other fees made necessary by homeowner making changes to the dwelling.
  18. AHW will not be responsible for costs or expenses in excess of $2,000 per service request (this includes cost of equipment, diagnosis, labor costs, and materials). AHW will not be responsible for any amount in excess of $10,000 aggregate under this contract.
  19. Unknown preexisting conditions are covered.
  20. At times, it is necessary to open walls, floors, or ceilings to perform a service. AHW will close the opening to a rough finish. This does not apply with central vacuum coverage.

9. Standard Coverage

The following items are covered by this contract. Items “not covered” have also been added to assist the homeowner.

  1. Interior Plumbing System:
    1. Leaks and breaks in water, vent, drain, and gas lines.
    2. Valves: shower, tub, faucet’s, and diverter.
    3. Toilets: tanks, bowls and interior mechanisms (replaced with builders standard white)
    4. Permanent sump pumps located within the perimeter of the foundation.
    5. AHW will pay a maximum of $1,000 per contract for the diagnosis, access, repair or replacement for heating systems that utilize steam, heated water, or glycol, electric baseboard.
    Not covered: Concrete covered or encased items, fixtures, shower enclosures, freezing, tile, water purification(odor, taste and color), filter, shower head, base pans, shower doors, shower arm, caulking, grouting, saunas and steam rooms, septic tanks, hose bibs, corrosion, rust, jets on a whirlpool, fire suppression systems, pressure regulators, mineral deposits, angle stop and gate valves, water pressure problems, water conditioning equipment, any parts added by homeowner after effective date of home warranty contract, and cross connection.
  2. Plumbing Stoppages:
    1. The clearing of stoppages in the drain, vent, and sewer lines up to 100 feet of point of access where ground level deanout exists.
    2. AHW is only responsible for only one sewer stoppage clearing per each separate main sewer line, secondary waste line, or toilet.
    Not covered: Stoppages that are caused by roots or collapsed lines outside of the foundation. The removal of water closets, costs associated with locating the problem, costs to access or install a ground level deanout, and any backflow damage.
  3. Water Heater:
    1. Gas or electric water heater up to 50 gallons in capacity.
    2. AHW will pay up to $1,500 maximum per contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboards, or boiler/water heater system.
    3. Heating element, pressure relief valve, thermostat, drain valve
    Not covered: Sounds and smell caused by sediment buildup, expansion tanks, holding and storage tanks, flues and vents, solar equipment, any items not mentioned, and any items added after the effective date of this contract.
  4. Heating System:
    1. Gas, oil, or electric heating systems, accessible ductwork.
    2. Burner, heat exchanger, blower, blower motor, gas valve, Programmable thermostat ( up to $100.00 less service fee).
    3. AHW will pay a $1500 maximum per contract for diagnosis, access, and repair or replacement of any glycol, hot water steam circulating, electric baseboard, or boiler/water heater system.
    Not covered: Concrete covered or encased items, registers, grills, insulation, fireplaces (gas, log, corn fueled), space heaters, filters, fuel tanks (oil, gas), humidifiers, heat lamps, electronic air cleaners, solar heating systems, flues and vents, piping for geothermal or water source heat pumps, well pumps for geothermal uses, cable heat and wood stoves, air cleaners, and any parts added by homeowner after closing of home.
  5. Ductwork:
    1. Ductwork from the heating system to the connection at the register or grill.
    Not covered: Registers and grills, dampers, insulation, ductwork where asbestos is present, insulation, and heating duct buried in a concrete slab.
  6. Interior Electrical System:
    1. Interior wiring, electrical boxes, fuse and breaker panels, switches, receptacles, exhaust fans.
    Not covered: Bathroom heaters, alarm systems, intercom systems, in home sound and theater systems, wiring outside of home, problems with code violations, concrete covered or encased electrical wiring, any parts added by homeowner after start of contract, light fixtures, fans(includes ceiling, attic, and paddle fans), improper wire size, fixing double-tapping, service entrance wires to covered structure, telephone system wiring, power failure or surges, low voltage, underground wiring, and any other wiring not mentioned in contract.
  7. Kitchen Appliances:
    1. Built-in Dishwasher: all parts covered except the following: Not covered: racks, trays, rollers, baskets, knobs and other cosmetic problems.
    2. Microwave oven: (built-in microwaves only) all parts covered except the following:
    Not covered: turn-table system, knobs, racks, door glass, handles, interior lights. Timers and docks are covered to a maximum of $100. less deductible.
    3. Oven/Range/Cooktop: All parts and components except for the following: Not Covered: knobs, dials, racks, lights, door glass, handles, interior lining, buttons, self-cleaning systems. Timers and docks are covered to a maximum$100 less applicable deductible.
    4. Garbage Disposal: All parts and components.
    5. Trash Compactor: All parts and components except for the following: Not covered: Knobs, removable baskets, locking mechanism.
  8. Garage Door Opener:
    1. Door opener, motor
    Not covered: Garage door, springs, hinges, motion sensors, transmitters, door adjustments, track, doors without safety return device, any items added by homeowner after effective date of contract
  9. Air Conditioning
    1. Compressor, condensing coils, blower, condenser unit, heat pump, valves, breakers, disconnect box, wiring. 2. Electric forced central air conditioning system or primary electric evaporative cooler unit, primary wall air conditioning unit and heat pumps. AHW will pay a maximum of $1500 per contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboard, or boiler/water heater system.
    Not covered: Parts and Components for gas air conditioning systems(except those using Freon), Freon evacuation, Freon recovery, electrostatic air cleaners, registers, insulation on hoses, filters, window or portable air conditioning units, grills, underground or outside lines and components for geothermal and or water source heat pumps, gas air conditioning systemsa, window mounted air conditioning systems, items imbedded in concrete, roof damage related to repairs to roof mounted units, any parts not mentioned in this contract, or any parts added by homeowner after effective date of contract.
  10. Evaporative Cooler
    1. Pump, belts, pulley system, water level float Not covered: window units, damage to roofing from repair and water run-off, cooler pads, roof supports.
  11. Central Vacuum System
    1. Vacuum unit, accessible ductwork and vents.
    Not covered: misuse or abuse to system, vacuum attachments, hoses, anything imbedded in concrete, closing up access through walls and floors in order to repair or replace system or components. Any parts added by homeowner after effective date of contract.

10. Optional Coverage

Homeowner is covered for the following items when additional payment is made at closing and contract states extra optional coverage.

  1. Air Conditioning
    1. Compressor, condensing coils, blower, condenser unit, heat pump, valves, breakers, disconnect box, wiring. 2. Electric forced central air conditioning system or primary electric evaporative cooler unit, primary wall air conditioning unit and heat pumps. AHW will pay a maximum of $1500 per contract for diagnosis, access, and repair or replacement of any glycol, hot water, steam circulating, electric baseboard, or boiler/water heater system.
    Not covered: Parts and Components for gas air conditioning systems(except those using Freon), Freon evacuation, Freon recovery, electrostatic air cleaners, registers, insulation on hoses, filters, window or portable air conditioning units, grills, underground or outside lines and components for geothermal and or water source heat pumps, gas air conditioning systems, window mounted air conditioning systems, items imbedded in concrete, roof damage related to repairs to roof mounted units, any parts not mentioned in this contract, or any parts added by homeowner after effective date of contract.
  2. Evaporative Cooler
    1. Pump, belts, pulley system, water level float Not covered: window units, damage to roofing from repair and water run-off, cooler pads, roof supports.
  3. Washer and Dryer (One of each only)
    1. All parts and components covered except for the following:
    Not covered: Knobs, soap dispensers, venting, handles, dryer hose, register, lint filters, dials, damage to clothing, abuse or neglect.
  4. Central Vacuum System
    1. Vacuum unit, accessible ductwork and vents.
    Not covered: misuse or abuse to system, vacuum attachments, hoses, anything imbedded in concrete, closing up access through walls and floors in order to repair or replace system or components. Any parts added by homeowner after effective date of contract.
  5. Refrigerator: all parts covered except the following:
    Not covered: insulation, racks, ice maker, shelves, handles, ice crusher, rollers and brackets, water dispenser, baskets, knobs, Freon evacuation, Freon recovery, Freon leaks, Freon recharging, food spoilage as a result of malfunction, refrigerators and freezers that require an additional compressor to function. Maximum liability of $1000.
  6. Roof Coverage: Leaks Only, $300 aggregate per contract.
    Not covered: Porches, Patios, Decks, Metal Roofs, missing or broken shingles, tiles, asphalt, flashing, attic vents, skylights, or if the roof has deteriorated so severely that it can't be fixed or needs to be replaced. Gutters, drains, leaks involving roof mounted installations, ice dam build-up, deck or balcony roofs, wood and underlayment, counter flashing, leaks resulting from or caused by any one of the following; acts of God, damages to persons, walking or standing on roof, incorrect repairs made by others, failure to perform normal maintenance.
